- Acceptance of Terms
By accessing, browsing, using or otherwise interacting with this Website or any Services provided by TIE (including but not limited to membership subscriptions, courses, digital downloads, newsletters, webinars, video content, calculators, tools, and any other materials), you acknowledge that you have read, understood and agree to be bound by these Terms of Use (the “Terms”), together with our Privacy Policy (which is incorporated into these Terms by reference). If you do not accept these Terms in full, you must immediately stop using the Website and the Services.
These Terms form a legal agreement between you and TIE Capital (Pty) Ltd. References in these Terms to “you” and “your” mean the user, visitor or member accessing the Website or using the Services.
- Definitions
For the purposes of clarity in these Terms, the following definitions apply (where the context requires):
- “Account” means any account registered on the Website to obtain access to Content or Services.
- “Member” means any person holding a free or paid Account with TIE.

- “Services” means the various offerings made available via the Website including, but not limited to, educational products, memberships, online courses, digital tools, newsletters, workshops and webinars.
- “Payment Processor” means any third-party payment service provider used by TIE to collect subscription or other fees (for example, Stripe, Paystack, Payfast, PayPal or similar providers).
- “Privacy Policy” means the Website privacy policy which describes how we collect, use, disclose and store personal information.
- Educational Purposes and No Financial Advice (General)
It is crucial that you read and understand the following statement carefully.
All Content provided on or through the Website by TIE Capital (Pty) Ltd trading as The Investor Experience — including, without limitation, our online courses, workshops, calculators, downloadable resources, videos, podcasts, newsletters, social media posts, email communications, live events, digital tools, templates, and any related materials — is prepared, written and published strictly for educational and informational purposes only.

For clarity and emphasis, the sections that follow repeat relevant educational and liability language in places where members may view it to ensure clarity for all users; such repetition is intentional for emphasis and does not create contradictory obligations or rights.
- Eligibility
- You must be 18 years of age or older to create an Account or otherwise access or use the Services. By creating an Account or using our Services you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding contracts.
- When you create an Account or subscribe to a membership, you agree to provide true, accurate, current and complete information about yourself as prompted by the applicable registration form and to maintain and promptly update such information to keep it true, accurate, current and complete.
- You acknowledge that providing false, misleading, incomplete or fraudulent information is grounds for immediate suspension or termination of your Account and may subject you to civil or criminal liability.
- Access to the Website and Services is intended primarily for users located in South Africa. If you are accessing the Website from a jurisdiction outside South Africa, you are responsible for ensuring that your use of the Website and Services complies with the laws of the jurisdiction in which you are located. TIE does not warrant that the Website or Services are appropriate or available for use in locations outside South Africa.
- TIE reserves the right to refuse or revoke access to any user who does not meet these eligibility requirements or who breaches these Terms in any way.
5. Account, Memberships and Services
5.1 Membership Types and Access
- TIE provides various membership options, including free access tiers and paid subscription tiers. Each membership tier has specific benefits, which may include access to certain Content, courses, tools, newsletters, community resources and other features. Details of membership tiers and benefits are available on the Website and in the relevant product pages.
- Membership benefits are personal, non-transferable and non-sublicensable. Memberships and the benefits attached thereto are granted only to the named Account holder. Any attempt to transfer, share, assign or otherwise allow any other person to access or receive membership benefits without the Company’s prior written consent constitutes a material breach of these Terms.
- TIE reserves the unfettered right to change, modify, suspend, withdraw, or discontinue any membership tier, package, benefit, price, feature or functionality at any time, in whole or in part. Where reasonably practicable, TIE will provide notice to existing Members of material changes affecting core benefits; however, TIE is not obliged to provide any minimum level or frequency of Content beyond what is expressly stated in the membership description at the time of purchase.
5.2 Account Responsibilities
- You are solely responsible for maintaining the confidentiality and security of your Account credentials (including your username and password) and for any and all activities that occur under your Account. You must notify TIE immediately of any unauthorised access or use of your Account, or any other breach of security known to you.
- You agree not to (and will not permit any third party to) use any other person’s Account, login or password for the Website or Services and to notify us immediately if you become aware of or suspect unauthorised use of your Account.
- TIE reserves the right to suspend, restrict or terminate access to an Account where we reasonably suspect unauthorized use, fraud, security issues, or breach of these Terms.
5.3 Payment Terms & Third-Party Processors
- Paid membership subscriptions and other paid Services are charged in accordance with the subscription plan you select (for example monthly or annual billing). All payments are processed by third-party Payment Processors engaged by TIE. The Payment Processor’s terms and privacy policy will apply to the processing of your payment information and you should review those terms carefully.
- By providing a payment method and subscribing to a paid membership, you authorise TIE and the relevant Payment Processor to charge your chosen payment method for all subscription fees, recurring charges, applicable taxes and other fees associated with the Services. You must ensure that the payment information you provide is accurate and up to date and you are responsible for updating that information should it change.
- TIE is not responsible for any Payment Processor failures, downtime or breaches beyond the Company’s reasonable control. Payment Processors are independent third parties and their services are governed by their own terms and conditions and privacy policies, which you should consult.
5.4 Subscription Management; Renewals; Chargebacks
- Paid subscriptions automatically renew at the end of each paid period unless you cancel before the renewal date via your Account settings or by contacting info@theinvestorexperience.com. You are responsible for managing and cancelling your subscription if you no longer wish to be billed.
- The Company will not be liable for any charges incurred where you fail to cancel or otherwise manage your subscription prior to automatic renewal. It is your responsibility to monitor your subscription status, billing cycles, and payment details.
- If a payment fails (for example due to insufficient funds, expired card details, or banking errors), TIE may, at its discretion, suspend access to paid content until payment is successfully completed. Multiple failed payment attempts may result in termination of the subscription.
- If you initiate a chargeback or reversal with your bank or payment provider without first contacting TIE to resolve the dispute, TIE may suspend or terminate your Account and will pursue recovery of outstanding amounts (including reasonable administrative, collection and legal costs) to the fullest extent permitted by law.
5.5 Cancellation, Refunds and Billing Disputes
- You may cancel your subscription at any time. Cancellation will be effective at the end of the current billing period and you will retain access to the applicable paid benefits until the end of that billing period unless otherwise agreed. Log in to your account dashboard to manage or cancel your subscription.
- Refunds are considered on a case-by-case basis and are not guaranteed. TIE will consider refund requests in good faith and may issue refunds where required by applicable law or where TIE determines a refund is appropriate. Unless otherwise required by applicable law, no refunds will be made for unused portions of a paid period, partial periods, or missed Content.
- Any request for refund or billing dispute must be submitted to info@theinvestorexperience.com within thirty (30) days of the date of the charge and must include the Account details and a brief explanation of the claim. TIE reserves the right to investigate and to withhold refunds in instances where there is evidence of abuse, fraud, evasion, or repeated cancellations associated with misuse.
- Where refunds are provided, they may be made in the original payment currency and via the original payment method where practicable in either the full amount or a portion of the subscription fees.
5.6 Suspension and Termination for Breach or Misuse
- TIE may, in its sole discretion and without prior notice, suspend, restrict or terminate any Account and/or access to the Website or Services where it reasonably suspects: (a) a breach of these Terms; (b) fraudulent or unlawful activity; (c) misuse of the Website or Services; or (d) any other conduct which is detrimental to other users or to the business or reputation of TIE.
- Suspension or termination does not affect any accrued rights, fees or liabilities which arise prior to suspension or termination. TIE may retain certain information after termination in line with its Privacy Policy and applicable law.
5.7 Member Conduct and Acceptable Use
- Members must at all times use the Content and Services for lawful, personal and educational purposes only. Members must not reproduce, distribute, transmit, publish, display, perform, or create derivative works of any Content for commercial purposes unless they have obtained the Company’s express prior written consent.
- Members must not post, upload, or otherwise distribute content that is unlawful, defamatory, discriminatory, harassing, obscene, infringing, or otherwise objectionable. Members must not attempt to circumvent technical protections such as access controls, digital rights management, watermarking, or any other protective measures applied to Content.
- The Company reserves the right to remove or block content and to suspend or terminate Members that breach this provision. TIE reserves the right to pursue injunctive relief or other remedies to prevent or address unauthorised use.
5.8 No Obligation to Provide Content; “Side-Hustle” Notice and Content Availability
- Members expressly acknowledge that while TIE endeavours to provide Content and member benefits in accordance with the descriptions on the Website, the Company does not guarantee a specific quantity or frequency of Content beyond any express commitments stated in the applicable product or membership description at the time of purchase.
- TIE is a founder-led, small business operation. The provision, frequency and volume of Content may vary due to operational, scheduling, personal, technical or other factors. While TIE will use reasonable efforts to maintain and publish Content, the Company does not accept any legal obligation to ensure that Content is provided on any particular timetable or at any guaranteed frequency. There may be times of heightened content delivery and times where less content is produced; Members accept and acknowledge this variability.
- To the maximum extent permitted by applicable law, TIE will not be liable for any loss, damage or cost arising from interruptions, delays, reductions in quality or availability of Content or Services, whether caused by maintenance, technical issues, third-party failures, hosting interruptions, force majeure events or any other event beyond the Company’s reasonable control.
5.9 Limitation of Liability for Membership Services
- The limited liability provisions detailed elsewhere in these Terms are expressly incorporated into this membership section for emphasis. To the fullest extent permitted by applicable law, TIE and its directors, officers, employees, agents, affiliates and contractors will not be liable for any indirect, incidental, special, punitive or consequential damages (including loss of profits, loss of business, loss of goodwill or loss of data) arising from or in any way related to the provision, suspension, termination or use of membership services, irrespective of whether TIE had been advised of the possibility of such damages.
5.10 Login Access & Security (Courses and Members-Only Areas)
- Access to courses and members-only areas is provided exclusively to the registered Member and is non-transferable. Purchase of a course or membership grants a limited, non-exclusive, non-transferable and revocable licence to access the relevant Content for the Member’s personal, non-commercial use.
- Members are responsible for the security and confidentiality of their Account credentials and all activity that occurs under their Account. Any sharing, sale, transfer, rental, or other distribution of login credentials is strictly prohibited and constitutes a material breach of these Terms. Where the Company discovers or reasonably suspects such behaviour, the Company may immediately suspend or terminate the Member’s Account without refund and pursue any available legal or equitable remedies.
- If you become aware of or suspect unauthorised access of your Account, you must notify TIE immediately at info@theinvestorexperience.com. The Company will take reasonable steps to investigate and may require verification of identity before restoring access or processing refund requests where misuse is suspected.
5.11 Taxes and Fees
- Unless otherwise stated, membership fees and prices shown on the Website do not include taxes, duties, levies, or surcharges imposed by any jurisdiction. You are responsible for the payment of any taxes, duties or similar charges imposed on you in connection with your subscription or purchase, other than taxes imposed on the Company’s income. Where applicable VAT or other indirect taxes must be collected by TIE, they will be charged in addition to the subscription price and shown separately on any invoice or billing statement.
5.12 Contact for Membership & Billing Matters
- For all membership administration, billing enquiries, cancellation requests, or refund/dispute requests, please contact info@theinvestorexperience.com. Please include relevant Account details, the date of the transaction and a description of the issue to assist TIE in responding promptly.
- Content Access and Use (Member & Non-Member Emphasis)
All Content, including but not limited to educational courses, videos, articles, templates, financial calculators, worksheets, webinars, newsletter content, downloadable resources and related materials made available on this Website are intended for personal, non-commercial, educational use only. The Company provides these materials to enhance financial literacy, to illustrate concepts and to educate users on general financial and business subjects. Content is supplied on an “as is”, “as available” basis and no warranty (express or implied) is given as to the accuracy, completeness, currency, reliability or suitability of the Content for any particular purpose.
The Company provides tools and knowledge for educational purposes only. The use, application and interpretation of the Content, tools and resources are at the sole discretion and risk of the user. TIE is not responsible for the content, operation, policies, security practices or terms of any third-party website, platform, or service and expressly disclaims liability for any loss, damage or cost incurred in connection with the use of such third-party services.
The inclusion of any link or embedded content does not imply endorsement by TIE of the linked site or content. If you access any third-party sites, you do so at your own risk and should review their terms and privacy policies.
- Intellectual Property
All Content, designs, text, graphics, logos, icons, images, downloads, course materials, trademarks, service marks and other materials available on this Website are the proprietary property of TIE Capital (Pty) Ltd or its licensors and are protected by applicable intellectual property laws in South Africa and international intellectual property laws and treaties.

This limitation applies to all claims, whether arising in contract, delict, negligence, strict liability or otherwise. You agree that your sole and exclusive remedy for dissatisfaction with the Website, Content or Services is to discontinue use of the Website or Services and, where applicable, to terminate your subscription in accordance with these Terms.
TIE provides educational content only and does not offer personalised financial advice. Any decisions, purchases or investments made by you based upon Content or Services are at your own risk. TIE will not be responsible for any decisions you make as a result of engaging with our Content or Services.
Safety Note: Be aware of fraudulent impersonation attempts. If you receive any communication from individuals claiming to represent TIE or its principals which appears suspicious, do not act on offers or transfer funds. Always verify the identity and authority of any person offering services on behalf of TIE. TIE accepts no liability for transactions with unauthorised third parties.
- Indemnity
To the maximum extent permitted by law, you shall indemnify, defend and hold harmless TIE and its officers, directors, employees, agents, affiliates and licensors from and against any and all claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising from or related to: your breach of these Terms, your use of the Website or Services, your User-Generated Content, your violation of any rights of a third party, or your violation of any applicable law or regulation.
This indemnity shall survive termination or expiry of your Account or subscription.
- Breach Notification
If TIE becomes aware of a security breach or unauthorised access affecting personal information that may materially affect you, TIE will take reasonable steps to contain and investigate the incident, and where required by applicable law (including POPIA), to notify affected users and the Information Regulator as soon as reasonably practicable. Notifications will include relevant information about the incident and steps that affected users may take to protect themselves.
- Governing Law, Jurisdiction and Injunctive Relief
These Terms and any dispute or claim arising out of or in connection with these Terms or your use of the Website or Services shall be governed by and construed in accordance with the laws of the Republic of South Africa. We make no representation or warranty that our content, services, or digital offerings are appropriate, lawful, or available for use in other countries.
You agree to submit to the exclusive jurisdiction of the South African courts to resolve any dispute, claim or controversy arising under these Terms, unless otherwise mutually agreed in writing.
Nothing in this clause prevents TIE from seeking injunctive or other equitable relief in any jurisdiction in order to protect its intellectual property, confidential information or other proprietary rights.

- Termination of Access and Suspension of Services
TIE reserves the right, in its sole discretion and without prior notice, to suspend, restrict, or terminate any user’s access to the Website, its Services, or any part thereof, at any time and for any reason, including but not limited to actual or suspected violations of these Terms, unlawful conduct, technical issues, maintenance, or business considerations.
Upon such suspension or termination, all rights granted to you under these Terms shall immediately cease, and you must promptly cease all use of the Website and its Content. The Company shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Website or any of its Services.
Termination of your access, whether as a member or general user, does not affect any obligations or liabilities incurred prior to the effective date of termination, including payment obligations or indemnities. The Company may, in its sole discretion, preserve information or communications as required by law or for legitimate business purposes.
- Assignment and Subcontracting
TIE may assign or subcontract any of its rights and obligations under these Terms at any time. You may not assign, transfer or novate your rights or obligations under these Terms without TIE’s prior written consent; any attempted assignment without such consent shall be void.
- Severability and Waiver
